Wedding Videography Terms & Conditions

In the following Terms & Conditions’ the Videographer shall mean Anderson Videography.  The Client(s) shall be those persons defined as the Bride & Groom on the booking form.  

 

The goods/services shall be the collective term for the attendance and filming of the wedding event and subsequent provision of an edited film(s) delivered via an online service. These Terms & Conditions cannot be varied in any way by the Client(s) unless such conditions are expressly agreed by the Videographer in writing.

 

1.      RIGHTS

The Client(s) hereby allow the Videographer to display any video covered by this contract and to generally promote the business in advertising, websites, sample albums etc. unless stated otherwise by the client.

 

2.      BOOKINGS

In the event that more than one Client(s) wishes to book Anderson Videography services on the same day, services will be booked on a first come, first served basis. Completion of a booking form, signature of Terms & Conditions and a payment of the booking fee of £50 will act as confirmation of booking and your date being held.

Rescheduled weddings will only be accommodated if the new proposed date does not conflict with any other commitments by the Videographer. If the Videographer is not able to attend the new proposed date, the deposit is non-refundable.

3.      LICENCE, COVERAGE AND REPRODUCTION

The property and any copyright or other intellectual property right in all material produced by Anderson Videography in performance of the goods/services belong to Anderson Videography, but the Client(s) shall be entitled to use the material supplied under this contract solely for personal use, subject to payment in full of all sums payable under this contract.

It is the sole responsibility of the Client(s) to secure permission of the venue to set up video equipment.

Video taken during the course of the event will be at the discretion of the Videographer although every effort will be made to comply with the Client(s) requirements.

​

For a booking involving a church ceremony or at certain venues, the Videographer’s movements are sometimes restricted by the official in charge. The area from which the Videographer is able to cover the ceremony may not be the Videographer’s choice and he cannot accept responsibility for any obstructed view should this be the case.

​

Due to a variety of lighting conditions and the limitations of digital sensors, some colours may alter throughout a sequence of video.

​

Although the Videographer will endeavour to capture all the package included in the price, sometimes this may not be possible because of being a one man camera shoot.

 

4.      PAYMENTS

A non-refundable booking fee of £100 of the total amount due will confirm your booking. The booking fee will be deducted from the cost of the total package. Payment in full of the remaining balance must be paid the day after wedding day.

5.      FORCE MAJEURE

The Videographer will endeavour to put the client in touch with another Videographer in the event they are unable to attend the event due to illness, injury, victim of crime etc. In the event of cancellation by the Videographer, or in the very unlikely event of total video failure, liability shall be limited to a full refund of any fees paid.

6.      OWNERSHIP

All RAW footage and computer files remain the property of the Videographer. Anderson Videography will not be solely responsible for the storage and maintenance of keeping RAW/digital files intact. These will be available to the Client(s) for at least one year from the date of the wedding.

​

The Client(s) understands that any RAW/digital files cannot be released to any other companies/firms/editors in order to be used or re-edited without the Videographer’s permission in writing.

RAW/digital files can be made available to the Client(s) if they so wish, and this will be charged at £100 for all RAW/digital files unedited from the event and will include RAW audio files. The Client(s) most provide portable hard drive for the files to be transferred and cost of postage if needed.

The Client(s) understand that any approach of a 3rd party to use of any footage, such as venues, suppliers etc for promotion, social media sharing or any form of distribution must have the permission of the Videographer & all posts & promotions must include a full credit & link to the Videographer’s website as a minimum.

7.      ON THE DAY AND EVENING

When the first dance is included in the wedding package, the latest the Videographer will work to on the wedding day is half an hour after the first dance, unless otherwise stated on the booking form.

The Videographer will abide by all rules of the facility and/or directions of the staff/facility coordinator with regard to video set up and will not be held responsible for absence of certain shots due to such rules and/or directions, or due to interference by wedding guests or vendors, including the photographer. The Client(s) acknowledges that Videography requires reasonable lighting and that production may be compromised due to low or poor light levels.

Prompting – If the order of the day includes the speeches before the meal then the Videographer will require a 5-minute set up time once the guests are seated and the bride and groom have been announced into the room – If the speakers are in different spaces in the room, time is required to refocus the cameras before commencing - this is to facilitate moving equipment into position and setting up audio recorders. We cannot be held responsible for loss of footage due to not being informed of the above.

If the Client(s) want to capture a particular guest(s) they must provide someone to guide the videographer to that person(s).

​

The Client(s) are solely responsible for informing the Videographer of destinations and timings throughout the day, and the Videographer cannot be held responsible for the absence of certain shots due to miscommunication from the Client(s). It is the Client(s) responsibility to inform the Videographer at the earliest opportunity should any destinations or timings change from the original set destinations and times described through email/written message communication.

The Videographer will not be held liable for any production problems beyond their control, e.g bad weather, accidents, interference from guests etc.

​

It is the Client(s) responsibility for obtaining and retaining any necessary permission, clearance permits etc., which may be required for the Videographer to video each event, public or private. The Client(s) assumes all responsibility for obtaining and retaining any requested camera positions and is solely responsible for the quality of the final production resulting from the use of, or inability to use, such camera positions.

It is the Client(s) responsibility to ensure no extra charges will be incurred by other vendors. This includes Church weddings where there may be a video production or filming fee, organist fee, choir fee etc. In these cases it is the Client(s) responsibility to pay these costs.

​

The Client(s) acknowledges that any direction given from the Videographer in regards to audio set up and recording is in the interests of recording the best quality audio quality for that event, e.g placing a lavalier microphone and recorder onto the Client(s) for their wedding ceremony, and should the Client(s) wish to not co-operate with the Videographers advice then the Videographer cannot be held responsible for any quality loss of audio recording.

8.      PAPARAZZI WEDDING GUESTS

The Videographer cannot be held responsible for absence of certain shots due to wedding guests refusal to move out of shot or failure for wedding guests to accommodate the Videographer as he moves around the venue. In the spirit of cheerful cooperation the Client(s) agree to give the Videographer precedence over wedding guests in order to film the required content for the wedding production.

9.      PERSONAL ACCIDENT

The Videographer cannot be held responsible for any personal accidents during a video shoot.

 

10.    EDITING & POST PRODUCTION

All editing and post production will be carried out to the Videographer’s discretion and using the Videographer’s style. Pleasing colour balance and illuminance will be provided but due to greatly varying lighting conditions, this cannot be guaranteed. The Videographer will re-touch and finish the video according to his own discretion.

The Videographer will provide a free 1-hour editing session once the finished product has been released to the Client(s) for any changes to be made & this must be instructed by the Client(s) within 14 days of the date of delivery. Any extra editing time after this will be charged at an hourly rate of £45 per hour for any changes with a minimum of two hours charged.

​

The Videographer has creative control over the production, including any music choices made. The Videographer will liaise with the Client(s) to best meet their requirements, however the Client(s) understand that the Videographer has the final say. 

​

The Client(s) agree that they have critically reviewed the Videographer’s editing style and viewed previous works, and therefore the final product cannot be subject to rejection based on personal taste or aesthetic criteria as they are familiar with the artistic style of Anderson Videography.

​

The Videographer will deliver all products to the Client(s) via an online delivery service. Any problems that occur with the delivery service, such as but not limited to having access problems, the delivery service closing down, the inability to download films due to technical issues etc is not the Videographers responsibility & he is not liable.

​

The Videographer will endeavour to produce the films/products in a timely manner, however the Client(s) understand that at certain points of the year due to high demand that there may be a delay in their films being produced/delivered. During normal circumstances the Videographer will aim to have all films delivered to the Client(s) within 1 months of their wedding day, although this is not a guarantee,

The Client(s) agree that they cannot edit, manipulate or change any film/photo/product in any way, including the use of filters on social media platforms. This is to ensure that the true representation of the Videographers work is maintained. Changing any photo/film/product by the use of filters or editing applications will be considered a breach of contract.

11.    CANCELLATIONS

In the event of the Client(s) cancelling their booking the booking fee of £100 is non-refundable.

In the event of the Client(s) cancelling their booking before the date 4 weeks prior to the event, no other charge will be incurred other than that of the deposit which is non-refundable. 

​

Should the Client(s) cancel their booking in the 4 weeks leading up to the date of the event then a cancellation fee of 40% of the total value of the package originally booked will be payable to the Videographer and will be considered liquidated damages to the Videographer due to the Videographer being unlikely to find other work within that timeframe.

​

In the event of the Client(s) cancelling their booking on the day of the event then a cancellation fee of 60% of the total value of the package originally booked will be payable to the Videographer and will be considered liquidated damages to the Videographer due to the Videographer being unable to find other work within that timeframe.

​

The Client(s) understand that reasons such as divorce or annulment after the wedding production has been completed does not affect the service that has been provided by the Videographer and therefore the Client(s) have no basis to request a refund for the services provided.

​

Anderson Videography reserves the right to terminate the contract at any time for any reasonable cause, e.g. accident or ill health, in this event all monies will be refunded in full.
